1. Agreement to Terms

By accessing or using the Tallysis website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Services

Tallysis provides custom software development services including but not limited to:

  • Custom software development
  • Mobile application development
  • AI and machine learning solutions
  • Blockchain development
  • Cloud infrastructure and DevOps
  • Compliance and security consulting

All services are provided subject to separate written agreements between Tallysis and the client.

3. Intellectual Property

The content, features, and functionality of our website are owned by Tallysis and are protected by international copyright, trademark, and other intellectual property laws.

For custom development projects, intellectual property rights will be defined in the project agreement. Generally, upon full payment, clients receive all rights to custom-developed software created specifically for them.

4. User Responsibilities

You agree not to:

  • Use our services for any illegal purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or viruses
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of our services

5. Payment Terms

Payment terms are specified in individual project agreements. Generally:

  • Fixed price projects require milestone-based payments
  • Time & materials projects are billed weekly or monthly
  • Dedicated team arrangements require monthly advance payment
  • Late payments may incur interest charges
  • Services may be suspended for non-payment

6. Confidentiality

Both parties agree to maintain confidentiality of all proprietary information shared during the course of the engagement. We will sign NDAs as required by clients for sensitive projects.

7. Warranties and Disclaimers

We warrant that our services will be performed in a professional and workmanlike manner. However:

  • Services are provided "as is" without warranty of any kind
  • We do not guarantee uninterrupted or error-free service
  • We are not liable for third-party software or services
  • Client is responsible for data backup and security

8. Limitation of Liability

To the maximum extent permitted by law, Tallysis shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability shall not exceed the amount paid by the client for the specific service giving rise to the claim.

9. Termination

Either party may terminate services:

  • For convenience with 30 days written notice
  • Immediately for material breach by the other party
  • For non-payment of fees

Upon termination, client shall pay for all work completed up to the termination date.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
